Terms of Service

Strikes

1. Strikes are associated with username/brand/title. (For example: if your username is “cosmic_flower_32” and you gain strikes, any name attached to your theme, aesthetic, username, style, etc, will KEEP those strikes.)

2. You cannot “take away” strikes, however good deeds do make a difference.

3. I will tell you when you officially have a strike, but not when you’ve surprised me with a “good deed”.

4. Three (3) strikes = BLOCK, blacklist, and immediate termination of any commission, owed art, trade, etc. (Blacklist is a block on ALL platforms. I will NO LONGER do any kind of business with you after you receive a blacklist. You cannot redeem yourself from a blacklist.)

5. If you are caught and called out for theft, reposting intellectual property, harassment, bullying, guilt tripping, backcharging, or fraud, you immediately acquire all three (3) strikes.

Payments

1. United States Dollars only. (Paypal converts other currencies!)

2. Payments must be made through PayPal or Venmo. KoFi is a potential alternative.

   1. PayPal payments must be made through “Goods and Services”.

   2. Leave a note on your PayPal and Venmo payments with your username/name and with what you are purchasing.

   3. Toggle off your shipping address IF you DO NOT need to receive a psychical, tangible item, before you confirm your payment in PayPal.

3. Gift Cards will be accepted at my discretion or during special offers. If there is a difference in a gift card value and your total, you will be expected to pay off the remaining balance either via PayPal or Venmo. Gift cards can be physical mailed cards (NOTE: I will not begin work past the sketch stage until card is received in the mail!) or digital, emailed cards.

4. I will accept time payments on orders that exceed $50. When you order, request time payments, and I will give you a deadline.

   1. I will only work up to the sketch/concept phase until full payment is received.

5. Rush Charges may be requested at any point during a commission process:

   1. If I have only 1-3 days from the time you notify me, I will assess the complexity of the piece and give you a quote. It could be anywhere from $50.

   2. If I have 3-5 days from the time you notify me, expect $30.

Refunds

1. Only a 60% refund will be given at the sketch/concept phase.

2. Only a 30% refund will be given at the lineart phase for illustrations.

3. NO refunds for illustrations:

   1. After color has been laid.

   2. After any finalized images have been sent.

   3. After communication has ceased for 2+ weeks.

   4. If you obtain all three (3) strikes and require a blacklist.

4. Full refunds will only be given:

   1. If I am unable to complete your commission for any reason.

   2. If I completely ignored your commission purchase requests, and disregarded any changes to sketch/concept, color hues, markings, etc.

   3. If my timeframe (before I can even get to your commission) is too long for you, you may request a rush charge, or a full refund.

Custom Models

1. You are not allowed to repaint, touch-up (with exceptions), or otherwise modify any custom work done by myself on a model. Exceptions include:​​

   1. If model needs repair work to any extent, you may either make your own repairs, or arrange to have another artist complete the repairs. I may be available to do repairs, however this varies on the type of repair needed.​

   2. If a model needs any restoration, the above term can also apply.

   3. If a model is in a state of disrepair, you may have it stripped and redone as if it was a completely new job.

2. You are not allowed to upsell when reselling your model. Doing so will earn you one (1) strike and continuation of this will result in potential blacklist.

3. Refunds will be based on amount of work completed. 

4. I will only accept payments via PayPal for custom models.

5. Non-refundable security deposits of 20% will be required on orders exceeding $100.

6. If your model arrives damaged, a refund may be appropriate only if you have photos of the packaging as it arrived to you. If damage definitely came from shipment issues, I will work with you to my fullest extent to either provide a refund, arrange repairs or rework, or arrange for additional work of equal value of original purchase as a "make up" of the damaged model.

   1. I will not extend any effort to replace, repair, or refund any damages that I feel were NOT caused during shipping, and were caused by misuse. Accidents happen, but I am not responsible for them once the model arrives to you (excluding shipping mishaps). I may be able to repair damages caused, but they will be at additional cost.​

Ownership

1. All artwork is copyrighted to me upon creation. You cannot claim it as your own. Doing so will result in all three (3) strikes immediately and potential legal action.

2. Any characters custom ordered immediately belong to you upon completion. I retain ownership over the artwork itself, however I forfeit my claims of ownership of the character. This is so that the character, undoubtedly, 100% belongs to you.

3. You may repost my work only if you commissioned it, or if it is for you. Reposted work must be credited to me via link, tag, hashtag, mention, etc.

4. No one is permitted to trace or heavily reference my work. Do not add filters to reposted pieces, markup, edit, color, crop, add text, etc to my work.

   1. If you ended up with an unfinished commission from me (or for some reason saved my sketch-for-approval message) you are NOT allowed to edit this either. You may not finish it, commission another artist to finish it, or otherwise change it. You may use it for your character gallery, BUT, use it at your own risk, as I will NOT be sending unwatermarked versions until the final result.

3. You must update me if you change accounts, usernames, or platforms.

4. If I do not have a way to contact you, you will forfeit your commission, gain a strike, and not get a refund.

   1. If you have a custom model in progress at this point, I have complete jurisdiction to repurpose your forfeited project. ​I will hold onto the model for only one (1) month, as well as reaching out to whomever I believe may be able to contact you, before moving in my own direction with the abandoned project.

5. If you go on a hiatus, you must tell me when you expect to be back. I will put your commission on hold for that time. You are only eligible for the refund as listed above.

Character Designs & Adoptions

1. All purchasing terms apply.

2. All ownership terms apply.

3. There will be NO refunds on adopted designs OR customs.

4. For offers:

   1. You may offer various things which will be listed on the adoption posts.

   2. Offers must be completed within two (2) weeks from the acceptance date.

      1. You will earn a strike if you fail to even work on your offers.

      2. I am usually very lenient with extensions as long as we have done business before, or if you have WIPs.

5. When design trading, you must send your half first.

6. If a character was not created by me, it is up to you to abide by the original creator’s terms.

7. You may gift any of my open species to anyone! I only ask that you notify me AND get it approved.

   1. Transactions must be approved by myself as I do not want certain users to have access to my species due to blacklisting them. If a blacklisted person currently owns one, they may NOT trade and participate.

      1. If a blacklisted, non-owner obtains one, the supplier will gain a strike, and the character will be reclaimed by myself to be redistributed at my discretion.

8. You may trade my semi-open and closed species only between current owners of that species, and no one else.

9. You may not resell a design of my semi-open or closed species. This is subject to change, however it is in place to protect and ensure my species safety.

You automatically agree to my terms by ordering a commission from me. During the ordering process, I will directly link you to these terms. It is, however, completely up to you to read and understand them. Please ask questions if you are confused!
